December 25 4:00AM - 5:00AM Conclusion and Chazara - Simanim | We succeeded in getting to the bottom of כז: but did not complete the sugyah last night. For the first 15 minutes this evening, we will make an effort to finish the sugyah - and then we'll do a review by breaking down this sugyah into its units, summarizing the main issues and conclusions of the piece.

December 24 4:00AM - 5:00AM Conclusion of Simanim D'oraita or D'rabanan | Yesterday's shur, Leyma K'tanai, was an example of a "technical" part of a sugyah - in which the Gemara proposes that the Tannaim disagree about a particular principle - and then 'reads in' that disagreement to the respective views of the Tannaim of a mishna or baraita. Our efforts, as is to be expected from this type of discussion, are spent "lining up" the principles of the Gemara, which rejects the initial linkage. To that end, we made a chart of the different permutations and filled it in to clarify the various approaches.
Tonight, we will make a valiant effort to conclude our discussion - to see how the Gemara rules on the overall question raised here - Simanim D'oraita or D'rabanan and then draw out its implications for practical halacha. The relevant passages are the bottom of 27b and top of 27a.
Thursday night, the final shiur of the zman, will be a review of the entire sugyah - starting from 27a and continuing until 28a. Anyone who has not yet sent me his/her chazara/quiz on Ye'ush Sheloh mi'da'at is encouraged to do so by email at ravron@gmail.com

December 23 4:00AM - 5:00AM Leyma K'tnai | Tonight, we are going to cover the last third of the amud, in the section beginning with the words לימא כתנאי - "Leyma K'tnai" - in which the Gemara proposes that the issue we have been dealing with - ie if simanim are recognized by the Torah as the basis on which to
a) return lost objects
b) Identify a person as dead so that his wife can re-marry
or if they are merely a rabbinic enactment and therefore only serve as a basis to return lost objects, based on the principle of 'Hefker Beit Din Hefker'.

November 12 4:00AM - 5:00AM Ye'ush and Terumah | Last night, we began the new תא שמע dealing with one who was תורם שלא ברשות - who went to his neighbor's property and separated Terumah without the knowledge of the property owner.
Depending on the Ba'al habayit's response, the mishna decides whether the Hafrashat Teruma was effective or ineffective.
Questions to ponder:
- How is the Ba'al Habayit's statement indicative of his intent? Review the two cases in which the mishna says that the behavior of the Ba'al Habayit indicates serious intent
- In what case is his statement deemed sarcastic?
- Whose "camp" is this case a proof for - and why? Note Rashi's linkage between this case and hashavat aveida - what connects the two realms?
- what is the defense against this proof? Who offers the defense and what is unusual about this?
- HOW does the defense constitute a defense? But once we say this a NEW PROBLEM ARISES! What is the new difficulty that arises?

November 5 4:00AM - 5:00AM A Fresh start - Join us for Bava Metziah 22a | Dear Talmidim,
Tonight we begin the top of דף כב - the case of property being swept away by a river or stolen. The context is the continuing discussion of Ye'ush Sheloh Mida'at, if it constitutes halachic ye'ush or not.
For those of you who have watched the shiur in the archives, or have attended a couple of shiurim, but for one reason or another have not been able to attend regulary - a quick review of the issue:
In order for a finder to acquire a lost object, the original owner has to despair of retrieving it (have "ye'ush). This makes the property "hefker" or "ownerless" - thus permitting the finder to acquire it as his own.
Rava and Abaye are divided over whether there needs to be a conscious mental act of ye'ush (Abaye) or whether an object regarding which the owner will eventually give up on - be mit'ya'esh - ONCE HE FINDS OUT THAT IT'S GONE - enters a state of "ye'ush" automatically once it's dropped. (Rava) Until now, the vast majority of attempted proofs have been on behalf of Rava's camp, but deflected by Abaye's camp. The most recent case, that of ketziyot, was the rare instance in our discussion in which Abaye was on the offensive.

The chart illustrates how the latest תא שמע poses a difficulty for Rava, but is consistent with Abaye.

This evening we continue our trek through the תא שמע string of proofs from the middle to the bottom of כא:. They relate to the two cases of "leket" then of the "ketziot", the back-to-back תא שמעs we got up to at the end of yesterday's shiur. Recall that until now, the Gemara has been bringing proofs that have ATTEMPTED to proof the position of Rava, ie יאוש שלא מדעת הוי יאוש - which have been deflected by Abaye's camp, through the gradually unfolding "chiddush" that we discussed in Monday's shiur.

See the document uploaded to the site from several days ago for 21b. Each Tah Shma will be deflected by a "teirutz"/answer by the camp on the defense. Can you figure out the basis of the proof/attack question and the basis of the deflection of the proof? How does the first Q and A of the Gemara support Tosafot's claim from 21a on R. Yitzchak's allegiances?

October 21 3:00AM - 4:00AM The continuing Saga of "Peirot Mefuzarin" | Dear Talmidim,
Tonight, we continue to analyze the first sugyah in Elu Metziot, specifically, the case of Peirot Mefuzarin - or "scattered fruit". Yesterday, we learned the Gemara's "Ukimta" that the case is not a classical case of "Aveida" - a lost object - but rather ownerless property stemming from a calculated decision to be "mitya'esh" on the remaining grains of the threshing floor. The remainder of the sugyah relates to variants of the "Kav b'arba amot" ratio of dispersion.
Source sheets uploaded to the Webyeshiva site from the previous shiurim continue to be relevant to tonight's shiur.
