Course Description

We will be learning Masechet Bava Kama this semester, beginning with the ninth chapter, HaGozel Eitzim.  We will cover the discussions of the gemara itself, as well as the comments of Rashi and Tosafot.
We will emphasize a methodological approach to studying gemara, aimed at equipping the student with the tools needed to learn gemara on one’s own.

About Rabbi Yitzhak Zuriel
Rabbi Yitzhak Zuriel has been enjoying guiding students in how to learn and understand Talmud at WebYeshiva.org since its founding. He began his teaching career as a teacher and educational director at Michlelet Bruria in the 1980s. For over 20 years, he has been working as a software engineer at the company NDS (now Cisco) in Jerusalem, and was an editor and contributor to NDS's Torah journal, Chiddushei Torah@NDS, that was published annually from 1996-2014 . He and his wife reside in Ma'ale Adumim and are parents to five children and 13 grandchildren.

Introduction: theft and robbery (II)

First of all, I sincerely apologize for neglecting to record the previous shiur! I will do my best to remember in the future..

In the previous shiur, we read verses from the Torah and then studied selected halachot from the Rambam about stealing and the compensation issues  that are relevant to the gemara that we will be studying.

In this shiur, we will continue studying Rambam, in his section on robbery, and see the similar issues as treated there. Then we will begin learning the mishnayot of our chapter, chapter 9 of Bava Kama.

Introduction: Detailed laws of robbery (II)
In the previous shiur, we reviewed what we learned in the Rambam about theft (geneivah), and then went on to study the first chapter of the Rambam's Laws of Robbery (Gezeilah).  Please review this material and make sure you understand the various concepts that we underlined along the way.
 
In this shiur, we will continue in chapter 2 of Hilchot Gezeilah, specifically to focus on the halachot relevant to the material that we will be studying in the gemara. Following that we will begin with the Mishnayot of chapter 9 of Bava Kama.

Bava Kama Daf 93b: Mishna and first sugya: What kinds of changes confer rights to the robbed object?
In the previous shiur, we completed the selected introductory material from the Rambam and saw the parameters and concepts that are relevant for deciding if the robber has the right to retain an object that he took. If there are any questions on this material, we will discuss them at the beginning of this shiur. At the end of the shiur, we read the first mishna of chapter 9, which will be the focus of the gemara that we will learn in the weeks ahead.
 
In this shiur, we will read the second mishna of the chapter and discuss the differences between it and the first mishna. Then we will begin learning the first sugya in the gemara.

Bava Kama Daf 93b: Changes to stolen objects that are de-oraita and de-rabbanan
In the previous shiur, we first read and discussed the first two mishnayot of the chapter, which is the material that the gemara will be working with.   Then we started learning the gemara: we read, translated, and broke down the first part of the gemara into its logical segments. Please review this material; first make sure that you understand how we parsed the gemara, and if you can understand the gemara's difficulty with the mishna and the method by which Abaye resolves it.
 
In this shiur, we will go back through the segments of this part of the gemara in depth, and also see some of the comments of Rashi.

In the previous shiur, we discussed in depth the first part of the sugya, to understand the amoraim's difficulty with the mishna in light of a seemingly contradictory beraita, and then the alternative reading that Abaye gives the mishna to resolve the contradiction. We also read the comments of Rashi on the first part. Please review this material; if there are any questions we will discuss them at the beginning of this shiur.
 
In this shiur, we will continue to read and discuss the comments of Rashi on the answer of Abaye. Then we will read the alternative answer of Rav Ashi.

Bava Kama Daf 93b: How much is an irrevocable change? The case of whitening wool
In the previous shiur, we studied carefully Rashi's explanation of Abaye's answer to the initial question of the gemara, and how he understood the mishna and the halacha. We then read the next few lines of the gemara in which Rav Ashi's disagreement with Abaye and alternative reading of the mishna is brought, and studied Rashi's explanations of Rav Ashi as well. Please review this material; if there are any questions we will discuss them at the beginning of this shiur.
 
In this shiur, we will read a larger chunk of gemara that will take us nearly to the bottom of the page, which discusses the issue of bleaching wool and whether this should really be considered the kind of change that causes the gazlan to acquire the wool.

Bava Kama Daf 93b: How much is an irrevocable change? The case of whitening wool (II)

In the previous shiur, we read and translated the next chunk of gemara and then broke it down into its logical parts. Then we went back over it to understand in depth. We read the early mishnayot of chapter 11 of Masechet Hulin to understand the context of the difficulty brought in our sugya from the mitzva of Reishit HaGez, the obligation to give the first shearings of sheep to a kohen. Then we discussed the answer of Abaye, who resolves the apparent contradiction based on different authorship of the two clashing sources. Please review this material; if there are any questions we will answer them in this shiur at the beginning.

In this shiur, we will study the comments of Rashi on the kushya and on the answer of Abaye, and then read the very different answers of Rava and Rabbi Hiyya bar Avin. Then we will translate, map, and delve into the next segment of the gemara, which clarifies an apparent illogicity in the position of R.Shimon about shinui.

Bava Kama Daf 93b: Bleaching wool vs. dyeing wool; Sages of the opinion that shinui is NOT koneh
In the previous shiur, we reviewed the difficulty raised by the gemara regarding an apparent contradiction between anonymous tanaitic sources on the issue of whether libun (whitening) of wool constitutes enough of a change in the wool to effect the halachic change in the status of the wool and exempt it from the obligation of Reshit HaGez. We reviewed the answer of Abaye and learned the comments of Rashi on this. Then we discussed the very different approach of Rava and R.Hiya b.Avin to answering the difficulty. Finally, we read, translated and broke down the next segment of the gemara and basically saw the apparent difficulty in the position of R.Shimon, and how Abaye and Rava again use their different approaches to resolving the contradiction. Please review all this material and see if you can identify each source in the gemara with its authorship and to what case it refers.
 
In this shiur, we will discuss this last segment of the gemara in depth and see the comments of Rashi. Then we will begin the new part of the sugya, which brings a list of sages who disagree with the fundamental idea that we have been working with, namely that shinui is koneh, that physical change in an object changes its halachic status as we have seen so far.

Bava Kama Daf 93b-94a: Sages of the opinion that shinui is NOT koneh (II)
In the previous shiur, we reviewed the last part of the sugya about changes in wool and outlined the differences of opinion of the Tanaim according to the different understandings of Abaye and Rava. Then we began the new part of the sugya, in which Abaye presents a list of tanaim who disagree with our Mishna and are of the opinion that shinui (change) in an object does NOT halachically change its ownership. We discussed the first of these Tanaim, R.Shimon ben Yehuda whose position we already saw in the previous gemara, and read Tosafot's answer to the difficulty understanding Abaye's seemingly blanket statement in light of our understanding of R.Shimon ben Yehuda. Please review all of this material; if there are any questions, we will discuss them at the beginning of this shiur. 
 
In this shiur, we will continue down Abaye's list and understand how and why Beit Shamai disagree that shinui is koneh, paying attention to the way they derive their position from the relevant verse in the Torah. Then we will move on to R.Eliezer b.Yaakov.

Bava Kama Daf 94a: Abaye's list of sages who think that shinui is NOT koneh (III)
In the previous shiur, we studied the part of the sugya that identified where Abaye learned that Beit Shamai do not hold that shinui is koneh. We discussed the the prohibition concerning Etnan Zona as background to the halacha in the relevant beraita, and then explained the derashot of Beit Shamai and Beit Hillel in the verse, to which their halachic positions are linked. Please review; if there are any questions we will discuss them at the beginning of this shiur.
 
In this shiur, we will move on to the next tanaim on Abaye's list.

In the previous shiur, we finished seeing the sources brought for each of the tanaim in Abaye's list. These purportedly show in each instance that the tana in question disagrees with the principle underlying the mishna: that shinuy is koneh. Please review all this material; if there are questions we will discuss them at the beginning of this shiur.
 
In this shiur, we will first learn the comments of Rashi on the source for the last of the tanaim brought by Abaye,  namely R.Yishmael. Then we will see how Rav Papa takes issue broadly with Abaye, and how Abaye responds.  Finally we will see how Rava presents  an argument against Abaye for each of the cases (tanaim in the list).
